An end to the confrontation between the department of telecom and the private telecom operators over the 3G roaming pacts entered into by the latter does not seem to in sight with the former alleging that service providers had “not come with clean hands” and that they have “suppressed material documents”.

The allegation came in an affidavit before the telecom dispute tribunal TDSAT, where DoT had requested the latter to dismiss the telecom operators’ petition challenging the government directive to stop 3G roaming immediately.

As has been its stand from the beginning, the DoT, in the affidavit has also said that the 3G roaming pact by operators were “in violation of various terms and conditions of cellular mobile telecom service licenses and various terms and conditions of the notice inviting applications (NIA) dated February 25, 2010 for the 3G/BWA auction”.

DoT has asked the private operators, who include the top service providers of the country, to stop offering the 3G roaming to their subscribers in the areas where they had failed to win 3G spectrum in the auction held in 2010.

The telecom operators — Bharti, Vodafone, Idea, Aircel and Tata — had entered into agreement with each other to offer 3G services in the name of inter-circle roaming, thereby avoiding any spectrum usage charge or license fee to the government.

DoT further submitted in its affidavit that “in spite of the directions by this tribunal vide order dated December 24, 2011, the petitioners (operators) have not submitted the intracircle roaming agreements entered into with various telecom service providers. The present petition is liable to be dismissed on this ground alone.”

DoT had on Dec 23, 2011, issued notices to telcos saying their 3G roaming pacts were illegal and should be stopped immediately within 24 hours.

Following the order the operators, who have sought Prime Minister Manmohan Singh’s intervention and have also threatened to return the 3G spectrum if they were forced to stop offering the service, challenged DoT’s decision before TDSAT on the same day.

Passing an interim order on an urgent petition moved by operators against the DoT directive, TDSAT on December 24, 2011 restrained the government from taking any coercive action against them.

DoT also said that operators’ petition was also not maintainable as relief sought for would amount to altering the terms and conditions of the CMTS/UAS license agreement and the NIA for 3G/BWA Auction. “It may be noted there is no challenge to the terms and conditions of the CMTS/UAS license. However, by way of present petition the petitioners are mischievously seeking such reliefs which are contrary to the terms and conditions of the CMTS/UAS license and the NIA for 3G/BWA Auction,” DoT said.

Iran today tested missiles near the Strait of Hormuz, underlining its threats to close the vital oil-transit waterway as the West prepares to impose more economic sanctions.

The launch of two missiles took place on the final day of war games in waters east of the strait at the entrance to the Gulf, a navy spokesman, Commodore Mahmoud Mousavi, was quoted as saying by official media. Another missile was also to be tested, he said.

Analysts say Iran’s increasingly strident rhetoric, which has pushed oil prices higher, is aimed at sending a message to the West that it should think twice about the economic cost of putting further pressure on Tehran.

“We have successfully test-fired long-range shore-to-sea and surface-to-surface missiles, called Qader (Capable) and Nour (Light) today,” Deputy Navy Commander Mahmoud Mousavi told state television.

Despite his use of the term ‘long-range’, the semi-official Fars news agency said the Qader’s range was only 200 km, and no figure was given for the Nour. Iran is about 225 km at its nearest point from Bahrain, where the US Fifth Fleet is based, and about 1,000 km from Israel. However, its longest-range missile, the Sajjil-2, has a range of up to 2,400 km.

The show of military muscle was designed to show Iran’s ability to close the Strait of Hormuz through which 20 per cent of the world’s oil flows. Iran said on Monday it had no intention to close the Strait of Hormuz, but has carried out “mock” exercises on shutting it.

“No order has been given for the closure of the Strait of Hormuz. But we are prepared for various scenarios,” state television quoted navy chief Habibollah Sayyari as saying. The US Fifth Fleet said it would not allow shipping to be disrupted in the strategic waterway.

Tehran denies Western accusations that it is trying to build atomic bombs, saying it needs nuclear technology to generate electricity. The United States and Israel have not ruled out military action against Iran if diplomacy fails to resolve the Islamic state’s nuclear row with the West.

The United States, which keeps its Fifth Fleet based in the Gulf, has warned it will not tolerate a closure of the strategic channel.

Halfway through the 10 days of Iranian navy manoeuvres it sent an aircraft carrier, the USS John C Stennis, through the strait on what the Pentagon said was a “routine” passage. But Iranian political and military officials insist they could take that drastic step if the West imposes more sanctions, on top of others that have already taken their toll on Iran’s oil-dependent economy. — Agencies

The first weekday of the New Year began on a tragic note for several families of Ambala district, as 11 children died when their overcrowded school van (Tata Magic) collided with a truck on the Saha-Shahbad Road (about 20 km from here) this morning. The van driver, Subhash (25), was also killed in the accident.

The mishap occurred around 10 am near Shergarh village when the van, belonging to Arjun Public School, collided head-on with a speeding truck that was travelling towards Shahbad. Eight children, in the age group of 5 to 8 years, died on the spot while three others succumbed to their injuries on way to the hospital.

The mishap apparently occurred as the visibility on the road was low due to dense fog. However, eyewitnesses claimed both the truck and the van, which incidentally was overcrowded with 30 children against a capacity of 10, were travelling at high speeds. The truck driver fled the scene after the accident.

Belongings of the schoolchildren, including school bags and water bottles, lay scattered at the accident site. The van had been badly smashed in the accident. The injured were rushed to nearby hospitals in some private vehicles. Some of the injured were later referred to hospitals at Chandigarh.

Eight students were declared “brought dead” by the doctors at the Civil Hospital, Ambala, while one child succumbed to his injuries at the Shahbad government hospital. Two children breathed their last at the Government Medical College and Hospital, Sector 32, Chandigarh.

At present, three children are under treatment at the Military Hospital, Ambala Cantt, 11 are undergoing treatment at the GMCH, Sector 32, Chandigarh, while four are admitted to the PGI, Chandigarh.

As the news of the accident spread, irate parents of the children gathered at the Civil Hospital and staged a demonstration. The administration decided to handover bodies of the children to their families without any post-mortem examination. Heartrending scenes were witnessed as the tragedy befallen parents clutched on to the bodies of their little ones.

CM Bhupinder Singh Hooda visited the injured at the Army Hospital. He announced ex gratia to the families of those killed and injured in the accident. Haryana Education Minister Geeta Bhukkal, who was accompanying the Chief Minister, refused to heed to the demand of the parents to declare closure of schools for a couple of days ahead of the winter break starting from next week. She said school timings had been changed from 10 to 3.30 pm from tomorrow.

Hundreds of villagers and relatives of the deceased van driver blocked the Saha-Shahbad road, demanding arrest of the truck driver, who managed to escape from the scene of the accident. School director Vikram was silent on the tragedy. A team of senior civil and police officers of the district visited the accident site.

Family loses 3 children

Babu Ram Saini of Pasiala village was inconsolable as he waited outside the Civil Hospital to receive bodies of his three grandsons who were killed in the accident. His son Parmod and Vinod were also inconsolable. Parmod had lost two sons (Rahul and Rishab) while Vinod had lost his son Lavish in the accident. They were angry that the school authorities did not react to the gravity of the tragedy immediately.

Probe Ordered

The Haryana Government has ordered a magisterial inquiry into the circumstances that led to the tragic accident that claimed 12 lives, besides leaving several others injured.

The Sikh Community of Elk Grove (Sacramento CA) had 3 Sikh men murdered this past year and still the killers are at large.

On March 4. Surinder Singh, 65, and Gurmej Atwal, 78 Atwal and Singh were shot during one of their regular afternoon strolls together in the park.

Surinder Singh died on the spot from a shot to the upper torso, while Gurmej Atwal passed away on April 14.

The violence provoked repeated calls for tolerance from the community, which has collected $52,000 in reward money to go to anyone who provides information that would lead to an arrest.

Then again on May 19 two more Sikhs were shot in Elk Grove CA Balbir Singh Dhami 53 & wife Kuldeep Kaur Dhami by an unknown suspect who came in through Dhami’s front door started shooting.

Balbir Dhami died on the spot while his wife was rushed to the hospital has recovered. Sikh community with the Dhami have put together a $25,000 reward. Regardless of motive, within March-May months, there have been murders of three Sikhs – members of a community that is already sensitive to being victims of hate crimes.

No arrests have been made, both casses have gone unsolved. One of the hardest things a family can go through is not knowing the reason this happened to their loved one.

The Management Committee of Gravesend Gurdwara  is delighted that its Senior Vice President, Mr Bakhshish Singh Sodhi, has been awarded an MBE in the New Year’s Honours List.

Secretary of the largest Gurdwara in Europe, Narinderjit Singh Thandi said, “ I am delighted that Mr Sodhi’s contribution to building good community relations in Gravesend over a period of some 35 years has been recognised with such a prestigous  award. I have personally known him for over  40 years and he is a modest person who goes about his business quietly but effectively.  He has worked hard to build and help maintain good race relations in Gravesend. As the Senior Vice President of the Gurdwara he has already brought forward many ideas for how the Gurdwara should become an attraction for all communities living in and visiting Gravesham.”

Local Councillor, Brian Sangha, added, “ There are many, many unsung heroes in Gravesham who do so much to help build safe, strong communities. Mr Sodhi has over a long period of time set a good example for others to follow. His award is recognition of his immense contribution to harmonious race relations in Gravesham”.

BOSTON -- It was vintage Ray Allen. The ball swings from one side of the floor to the other and the NBA's all-time 3-point king comes around a pick or two before stepping up and nailing a jumper.

Allen went 3 for 3 from long range in the final quarter, scoring 11 of his 27 points in the fourth, and the Boston Celtics won for the second straight night over Washington, beating the winless Wizards 100-92 on Monday night.

"Ray made the big shots for us tonight," point guard Rajon Rondo said. "It was a team effort, but when we needed a bucket the ball seemed to find Ray."

The 36-year old Allen, the oldest player on the floor who prides himself on conditioning, looked like the one with the freshest legs when the game was on the line.

"Yeah, Marathon Man," joked Boston coach Doc Rivers. "He was great. He just kept going. I would never want to guard that guy. You can't imagine how many miles Nick Young had to go chasing him."

Rondo downplayed the amount of energy Allen showed.

"Ray runs every day," he said. "He'll probably run tomorrow. It's not a shock when he does what he did."
Paul Pierce had 21 points and eight rebounds for the Celtics (3-3), who pulled to .500 after losing their first three games of the season. Rookie Greg Stiemsma, making his first start, had 13 points and seven rebounds, and reserve Brandon Bass scored 12.

But it was Allen that carried the veteran Celtics during the game's key minutes.

"You look at the shots during that stretch; every time somebody made the tough extra pass," Allen said, crediting his teammates. "It's tough to guard that second and third pass."

Andray Blatche led the Wizards (0-5) with 28 points and nine rebounds, JaVale McGee had 17 points and 14 boards, and John Wall had 11 points. Head coach Flip Saunders didn't see much of the game from the bench after he was ejected 1:46 into the contest.

Allen was 6 for 7 from beyond the 3-point line.

Boston beat the Wizards 94-86 in Washington on Sunday.

Allen's fourth 3-pointer of the game, coming with 8:56 to play, pushed Boston ahead for good, 75-74. Bass then hit a foul-line jumper and, after a basket by the Wizards' Nick Young, Rajon Rondo found Marquis Daniels cutting backdoor for a layup. He was fouled on the play and made the free throw, increasing it to 80-76.

Bass then nailed another jumper -- this one from the right corner -- and Rondo had a breakaway layup, increasing Boston's lead to 84-76 with 6:21 to play.

The Wizards made one last run, closing it to 84-80 on Blatche's three-point play, but Allen hit a jumper on the left wing and followed it 43 seconds later with a 3 from the right wing.

"This game boiled down to coming down the stretch, winning time, you've got to make the right plays in the last two minutes every time or you don't have a chance, especially against a veteran team like this," said Wizards assistant coach Randy Wittman, who took over after Saunders was tossed.

Allen's third 3-pointer of the final quarter made it 95-87 with 1:30 to play.

Saunders was upset after Stiemsma blocked Rashard Lewis' shot and knocked him to the floor as play continued. He got up off the bench and screamed at the officials to earn the first technical, then walked to midcourt still protesting to earn the second and an automatic ejection.

"It was quick," Wall said. "I heard everybody complaining about the call Rashard got and then all of a sudden it was two technicals and he was gone."

Washington led 70-69 after three quarters.

Neither team held more than an eight-point lead in the first half, and it changed eight times before the Wizards took a 48-47 advantage into halftime.
