To whom it may concern,

I am writing to you in regards to news that has been blacked out by the media in India and is causing uproar amongst the Sikh nation, where protests and demonstrations are being held across the world by Sikhs. India is preparing to break its moratorium on the death penalty by hanging Bhai Balwant Singh Rajoana on the 31 March 2012 at 9am at Central Jail in Patiala, Punjab.

Bhai Balwant Singh Rajoana is facing the death penalty for the assassination of the former Chief Minister, Beant Singh in 1995. Balwant Singh was sentenced to life imprisonment. Life imprisonment in India is 14 years and Rajoana served 17 years in Patiala jail. Having served more than the actual life imprisonment set by the Indian government, Rajoana has now been awarded capital punishment of being hanged.

Although his death sentence was capable of appeal, Rajoana instead willingly expressed his desire to be put to death instead of showing faith in the widely acknowledged corrupt Indian justice system. Balwant Singh confessed his involvement in the assassination of Beant Singh, who was responsible for overseeing the mass genocide of Sikhs in the 1980s and early 1990s and ran operations that deliberately targeted civilians of Punjab. This lead to a period of fake ‘encounter’ killings, illegal detentions, mass rapes, illegal seizure of property and widespread intimidation of the Sikh population.

In recent years Amnesty International has welcomed the lack of executions in India, with the last one taking place in 2004, but expressed its concern that at least 50 death sentences are passed each year by the Indian courts.

By making this announcement, India is signalling to the world that when it comes to Sikh prisoners it is prepared to break the moratorium and reverse the trend to abolish the death penalty. The most recent announcement also comes on the back of the pre-mature release last month of Kishori Lal, who was awarded the death penalty in the murder of 3 Sikhs with a chopper knife on the 1 November 1984. Many in the Sikh community feel the Indian authorities are blatantly targeting Sikhs. Those responsible for the Sikh genocide in 1984, which saw up to 250,000 innocent Sikhs brutally murdered, burned and butchered alive, electrocuted, stripped naked and raped by mobs hired by the Indian government, have not been sentenced in the Indian courts or even given the capital punishment of being hanged. These criminals still roam the streets in India and have been let off scot-free!

I urge you, on behalf of the British Sikhs in the United Kingdom to please highlight this atrocity in any of your news coverage’s so that the world is aware of the injustice doings of the Indian government. We also urge you to also send any of your news reporters to India to take footage of what is happening. Peaceful protests and demonstrations are being held throughout Punjab. The Indian government has set curfews across Punjab and have moved in the Border Force and army to stop Sikhs from protesting and holding demonstrations against the ongoing injustice that India is showing Sikhs.

Sikhs in the UK have appealed to the Foreign Secretary to bring this matter up with Amnesty International and the Houses of Common. Other international Sikhs across the globe have also appealed to the state governments regarding the Bhai Balwant Singh Rajoana hanging.

Balwant Singh Rajoana , convicted and scheduled to be hanged on March 31 for the assasination of former Punjab Chief Minister Beant Singh , said on Tuesday that he doesn't want clemency.

In a letter to the Akal Takht , Rajoana said he "can't compromise on principles". 

A trial court in Chandigarh, meanwhile, is expected to decide on Rajoana's execution on Tuesday.
 
L.S. Jakhar, superintendent of Patiala jail, where Rajoana is lodged and is scheduled to be hanged March 31, had on Monday approached the Central Bureau of Investigation (CBI) special court in Chandigarh seeking deferment of the death warrant.
 
The Patiala jail superintendent had earlier returned the warrant saying that the legal circumstances of the Beant Singh assassination case were such that Rajoana could not be hanged till the Supreme Court decided all related issues.
 
The 'clemency for Rajoana' demand is gaining strength in the state with Punjab Chief Minister Parkash Singh Badal saying on Monday that the hanging of Babbar Khalsa International (BKI) terrorist Rajoana could not be carried out on March 31 in the present circumstances as there is a possibility of his getting relief in the assassination case.
 
In a statement, Badal said it was "necessary to await the outcome of the matter in the Supreme Court before executing the death warrant of Rajoana".
 
Citing the petition moved by the Patiala jail superintendent before the court, the Punjab chief minister said: "In view of the old cases and rules it is amply clear that Bhai Balwant Singh Rajoana could also get the same relief to be given to other accused in this case, whether he (Rajoana) has not filled any appeal."
 
"In view of these circumstances, it is clear that Bhai Balwant Singh Rajoana cannot be hanged," Badal stated.
 
He pointed out that if Rajoana is hanged now and the court gives relief later, no one would be able to give life back to him then.
 
Badal said that he would soon meet the President and prime minister to seek clemency for Rajoana. He said the Punjab government did not want the hard earned peace and communal harmony in the state to be disturbed by Rajoana's hanging.
 
Earlier, the Shiromani Gurdwara Parbandhak Committee (SGPC) filed a clemency petition with President Pratibha Patil for Rajoana.
 
Punjab's ruling Shiromani Akali Dal had on Sunday evening said it was willing "to go to any extent" to save Rajoana and asked the state government and the SGPC "to take all possible legal and other steps" to secure clemency for him.
 
A court in Chandigarh had issued the death warrant for March 31 and asked the jail authorities to execute Rajoana who had refused to defend himself in any court.
 
The Akal Takht had last week asked the Punjab government and the SGPC to initiate steps to save Rajoana from the gallows.
 
Beant Singh, a former Punjab chief minister (1992-95), who was largely credited with wiping out terrorism from Punjab, was assassinated by a human bomb, Dilawar Singh, at the high security Punjab civil secretariat on August 31, 1995.
 
While Jagtar Singh Hawara was the mastermind of the assassination, Rajoana was the second human bomb to be used in case the first assassin failed. Rajoana, during the entire 11-year trial, had maintained that he alone was responsible for the killing of Beant Singh.

As per information available with Sikh Siyasat, Parkash Singh Badal, the chief minister of Punjab, today made a statement on the issue of death sentence awarded by Chandigarh court to Bhai Balwant Singh Rajoana in state assembly, Chandigarh. He assured that he would meet the Indian President Pratibha Patil and Prime Minister Manmohan Singh to seek “clemency” for the Bhai Rajoana.

Badal read a prepared text/statement in the state assembly and went into the recent developments in the case. He “assured” the House that all legal and constitutional steps were being taken by the Punjab government to seek clemency for Rajoana, currently lodged in central Jail, Patiala . He is scheduled to be hanged on March 31, 2012.

Parkash Singh Badal did not uttered any word regarding passing a resolution in the Punjab assembly against the hanging of Balwant Singh Rajoana. It is notable that some months back Tamil Nadu state assembly passed a resolution seeking clemency for three Tamils who are facing death sentence for assassinating Indian prime minister Rajiv Gandhi.

These resolution do not change the legal situation so far as death sentence is concerned; but these resolutions have their own value. Firstly, they bring people’s voice on record of prime democratic institution; secondly they convey the expectations of masses to the Central government through proper channel. People of Punjab want a resolution be moved in the state assembly against death sentence awarded to Bhai Balwant Singh Rajoana. But keeping in mind the directionless state of politics in Punjab it is seems that political parties and legislators may not take initiative to represent the people’s will in this case.

The ruling Shiromani Akal Dal (SAD) - Bharatiya Janata Party (BJP) created history in the Punjab Assembly by retaining power in Punjab, defying history which has not seen the incumbent returning to power in the last 46 years.
The SAD-BJP alliance won 68 seats, while Congress won 46 seats. The Others won three seats as results were declared for all 117 seats in Punjab Assembly.

Punjab Chief Minister Parkash Singh Badal and his son and Deputy Chief Minister Sukhbir Singh Badal have won from Lambi and Jalalabad respectively.

Reacting to the victory, an elated Parkash Singh Badal said, "One of the two reasons we won is that the BJP gave its full fledged support to us. And the other reason which worked for us is the work we have done for development in the state."

The results came as a disappointment for the Congress. "I take full responsibility for the defeat. We will introspect and look into the reasons that led to our loss," Punjab Congress chief Captain Amarinder Singh said.

"I am extremely disappointed with Punjab. Punjab requires deep introspection and inquiry," Congress spokesperson Abhishek Manu Singhvi said.

Punjab Congress President Amarinder Singh retained Patiala constituency by defeating SAD's Surjit Singh Kohli by a margin of 42,318 votes, while his son Raninder Singh lost by 6,930 votes from Samana seat.

Congress has won the seats of Talwandi Sabo, Amritsar Central, Rajpura, Nabha and Patiala, while the SAD has won Balchaur, Attari, Faridkot and Ghanuar and the BJP Amritsar East.

Punjab BJP President Ashwani Sharma won from Pathankot defeating his nearest Congress rival Raman Bhalla by a margin of 17,586 votes.

Navjot Kaur, wife of BJP MP from Amritsar Navjot Singh Sidhu, has won from Amritsar (East) constituency, defeating her nearest rival and Independent candidate Simarpreet Kaur by a margin of 7,099 votes.

Manpreet Badal's Punjab People's Party-led Sanjha Morcha failed to make any impact in the polls as it was not in a winning position from any seat.

Chief Minister Parkash Singh Badal's estranged cousin Manpreet Badal lost from both Gidderbaha and Maur seats, finishing third in both the seats.

From Balachaur constituency, SAD's Nand Lal beat Shiv Ram Singh of BSP by a margin of 14,857 votes, while from Rajpura seat Hardial Singh Kamboj of Congress beat BJP's Raj Khurana by a margin of 31,510 votes.

From Faridkot, SAD's Deep Malhotra beat Avtar Singh Brar of the Congress by a margin of 2,727 votes and SAD's Harpreet Kaur beat Madan Lal Jalalpur of Congress by a margin of 1,778 votes from Ghanaur.

Sadhu Singh of Congress won from Nabha (SC) constituency defeating his nearest SAD rival by a margin of 22,548 votes.

Congress' Jeet Mohinder Singh Sidhu bagged the Talwandi Sabo assembly seat, while O P Soni of Congress won from Amritsar Central, defeating his nearest rival Tarun Chugh of the BJP by a margin of 12,797 votes.

SAD's Nand Lal beat Shiv Ram Singh of BSP by a margin of 14,857 votes from Balachaur assembly constituency, while Gulzar Singh Ranike of SAD beat Tarsem Singh of the Congress by a margin of 4,983 votes from Attari (SC) seat.

From Jaitu (SC) seat, Joginder Singh of Congress defeated Gurinder Singh of SAD by 6,342 votes.

From Dakha, Manpreet Singh of SAD defeated Jasbir Singh Khangura of Congress by a margin of 16,338 votes.

Harmeet Singh Sandhu retained his Tarn Taran seat defeating Congress' Dharamvir Agnihotri by a margin of 4,621 votes.

SAD suffered a jolt from Sultanpur Lodhi in Kapurthala district when senior leader and Minister Dr Upinderjit Kaur lost to Navtej Singh of the Congress, who won by a margin of 4,298 votes.

From Adampur constituency in Jalandhar district, Pawan Kumar Tinoo of SAD defeated his Congress rival Satnam Singh Kainth by a margin of 19,306 votes.

Former Indian Hockey captain and SAD candidate Pargat Singh won from Jalandhar Cantt by defeating Congress rival Jagbir Singh Brar by a margin of 6,798 votes.

From Sahnewal assembly constituency near Ludhiana, Sharanjit Singh Dhillon of SAD won by a margin of 21216 votes over Congress' Vikram Singh Bajwa.

From Barnala, Congress' Kewal Singh Dhillon retained the seat defeating Malkit Singh Kittu of Congress by a margin of 5,522 votes.

Amritsar West was bagged by Raj Kumar of Congress who beat BJP's Rakesh Gill by a margin of 11,591 votes.

Khadoor Sahib (SC) seat went to Congress' R S Sikki who defeated SAD's senior leader and sitting MLA from Navshera Panuan, Ranjit Singh Brahmpura, by a margin of 3,054 votes.

From Mohali, Balbir Singh Sidhu defeated SAD's Balwant Singh Ramoowalia by a margin of 16,756 votes.

Gurdaspur went to SAD's Gurbachan Singh Babbehali who retained the seat defeating Congress' Raman Behl by a margin of 21,570 votes.

From Kartarpur segment, Sarwan Singh of SAD beat Jagjit Singh of Congress by a margin of 823 votes.

Kotkapura in Faridkot district was won by Mantar Singh Brar of the SAD who defeated Congress' sitting MLA Ripjit Singh Brar by a margin of 18186 votes.

Rampura Phul in Bathinda was won by SAD's senior leader Sikander Singh Maluka, who defeated sitting MLA Gurpreet Singh Khanger of Congress by 5136 votes.

Punjab's Revenue Minister, Ajit Singh Kohar, sitting MLA from Lohia, defeated Col (retd) CD Kamboj of Congress from the Shahkot assembly segment by a margin of 5,435 votes.

From Jalandhar Central, BJP's senior leader and former Minister, Manoranjan Kalia won by a margin of 1,065 votes over his Congress rival Rajinder Beri.

Anandpur Sahib went to BJP when senior leader Madan Mohan Mittal defeated Kanwar Pal Singh of Congress by a margin of 7,886 votes.

From Phagwara, Som Prakash of the BJP defeated Balbir Kumar Sodhi of Congress by a margin of 14,579 votes.

Congress is contesting all 117 seats, while SAD 94 and BJP 23. In the last election SAD had won 50 seats, Congress 42, BJP 19 and independents 06.

1,078 candidates were in the fray, including 93 women and 417 independents in Punjab. Voting was held in the state on January 30. There are 52 counting centres across the state.

Nearly 78% of the 17.6 million voters in the state exercised their franchise Jan 30. The voting percentage was an all-time record in assembly polls in the state.
